Smoking countdown

The Smoke-free (Premises and Enforcement) Regulations come into force on 1st July 2007. We explain what this will mean and where you can find out more.

The regulations clarify what is meant by enclosed and substantially enclosed space and give details on enforcement agencies. The enabling legislation is the Health Act 2006.

Essentially the new requirements mean that smoking will not be permitted in any 'enclosed space'. This includes rooms and portable units previously set aside for smoking. EEF is drawing together guidance to help with the practical issues which the changes raise.

Local authorities will be responsible for enforcing the regulations in workplaces. Government will be publishing three further sets of Regulations, one that contains the remaining detail from the draft General Provisions Regulations and the Exemptions and Vehicles, and Penalties and Discounted Amounts Regulations.

There will also be the explanatory memorandum accompanying the Premises and Enforcement Regulations and a fact-sheet explaining the content of the regulations.

NICE (the National Institute for Health and Clinical Excellence) is an independent organisation responsible for providing national guidance on promoting good health and preventing and treating ill health, supported by the NHS. NICE intends to publish the Workplace Smoking Intervention guidance in the Spring.
