social security considerations

Companies may find it useful to be aware of the following background information on the social security rules that apply to employees on leaving employment:

  • employees who are dismissed for misconduct may be disqualified from Jobseekers Allowance for up to 26 weeks;
  • employees may also be disqualified from benefit for up to 26 weeks if they leave their employment voluntarily and without just cause;
  • an employee who receives a termination payment may have that payment treated as income, and so may be disqualified for a period from receiving benefit.
