Capability - Performance

Most organisations today are “cut to the bone” in terms of the number of employees they can support. As a result, the impact of a poor performer can at best be irritating to colleagues and at worst be very costly. However, action to remedy this must take account of the requirement in law to act fairly when dealing with employees whose performance is below expected standards. Employees dismissed for performance issues can all too easily bring successful tribunal claims if their employer has not followed the required procedures, including the statutory dispute resolution procedures.
