Handling Discipline

Course Overview

A fair and consistent approach to discipline in the workplace has always been desirable but now, more than ever, is essential.  If an employer fails to follow the correct Statutory Disciplinary and Grievance Procedures for certain types of disciplinary sanction and for dismissal, an Employment Tribunal is entitled to find a dismissal automatically unfair, without even needing to hear evidence.  This may increase its normal award of compensation by between 10% and 50%.  The course will take account of recent EAT guidance on what constitutes a grievance and other case laws on the new rules.

Such mistakes can be costly and the aim of this course is to ensure that all managers who might be involved in the disciplinary process are fully aware of the relevant law.

  • Statutory Disciplinary and Grievance Procedures - minimum procedural standards - 3 step procedure
  • ACAS Code of Practice
