Terms and Conditions
Definitions
The seller, we us - EEF, its staff, authorised representatives
and assignees.
The customer, you - whoever orders the Goods.
Goods - the items fitting the description in your order,
available from EEF's list of items.
Force Majeure - any circumstances beyond our reasonable
control, such as accidents, flood, fire or other natural disasters, and
unlawful industrial disputes.
Contract - the agreement between us and you made when we accept
your order - your request for the Goods.
Applicable Conditions
These are the only conditions which shall apply to the supply of Goods pursuant
to your order. Any variations to them must be agreed in writing by EEF's
National Marketing Manager except where required by law.
Accuracy of Description
We will only be liable to supply the Goods which you describe accurately in your
order.
When your order does not accurately describe the Goods we will use our best
endeavours to supply the correct Goods. If you do not accept that these
are correct you can return them to us at:

Delivery
You will accept the Goods delivered to the address specified on your order.
Goods will be despatched within three working days of receipt of payment except
for reasons of Force Majeure.
Unless otherwise agreed, we will charge you the fee specified at the
time of your order for delivery by Royal Mail.
We may charge you for the cost of delivery by any other method or to other
countries.
Such costs are included in the total amount shown on your order.
Where we cannot despatch the Goods within three working days we will promptly
advise you of the reason. We may make a partial delivery of your order where
not all items are available. You have the right to return the partial delivery
at our expense by the most economical method, within five working days of
receiving it.
Inability to Supply
If we notify you in writing that we are unable to deliver the Goods as specified
for Force Majeure or 'out of stock' reasons, you will allow us to deliver
within a further reasonable time. This will depend on the nature and
duration of the Force Majeure or 'out of stock' position.
You may return at our expense any Goods that are not delivered within that
further reasonable time by the most economical method, but not within 14 days
of being notified of our inability to supply. On safe return of the Goods in
saleable condition we will cancel the invoice.
Ownership of the Goods
The Goods remain our property until you pay for them, but you will be
responsible for their condition once they are delivered to the address
specified in your order.
Rejection
We aim to take care to provide Goods of a merchantable quality, which are fit
for their purpose and value for money. These terms and conditions show how we
aim to do this, and do not affect your legal rights.
If you notify us by telephone within 5 working days of receipt of any Goods
which are defective, confirm this in writing at our request and then return
them at our expense stating the reason you are rejecting them, we will replace
with Goods in an acceptable condition.
We will refund the price of any Goods which we are unable to replace with Goods
in acceptable condition.
If you accurately describe the Goods in your order form you may within 5 days of
receipt return any Goods that do not conform with your description. We will
replace at no extra charge these with Goods that correspond to your
description.
Payment
The price payable for Goods shall be the total price specified on our website at
the time you place your order. All prices are not inclusive of VAT which shall
be payable in addition by you at the applicable rate.
You will make full payment for the price of the Goods and any delivery charges
as defined above. Your payment must be in pounds sterling, free from any bank
or transmission charge.
Intellectual Property Rights
You will protect our copyright and all other intellectual property rights in the
Goods, while they remain your property. You will notify any subsequent owner of
such rights in the Goods.
Returns Policy
We will replace at no extra cost any Goods damaged before or on delivery, if you
notify us by telephone, and confirm this in writing at our request, within 5
days of their receipt.
We will replace at no extra cost any Goods which have been lost in transit if
you notify us by telephone, and confirm this in writing at our request, within
21 days of us receiving your order or the publication date of the Goods,
whichever shall be the later.
EEF’s agreement must be sought before any Goods are returned for credit.
Cancellation
Where you are a consumer (non-business customer) and entitled to cancel under
the Consumer Protection (Distance Selling) Regulations 2000, you may cancel
your order without cause within 7 days of receipt of the Goods. Otherwise you
will not be entitled to cancel any order that we have already entered into our
order processing system.
Seller’s Liability
EEF’s liability to the customer for negligence, breach of contract and statutory
duty is limited to the cost of replacing the Goods ordered. It is not intended
that any contract between EEF and the customer for the supply of goods should
be enforceable by any third party. Nothing in this Contract is intended to
limit liability for death or personal injury.
EEF accepts no liability for any reliance placed upon the contents of any
publication supplied. The said material is intended for reference purposes only
and is not intended, nor should it be used, as a substitute for
professional advice and judgement or to provide legal advice with respect to
particular circumstances.
Enforcement
Our failure to enforce any of these conditions will not prevent us from
enforcing them at a later date.
If any condition is found to be invalid, it will not prevent all other
conditions being enforced.
Communications
Any notifications, request or other communication required under these
conditions will be in writing, including facsimile transmission, unless

Governing Law
The contract will be in the English language, governed by English Law and
subject to the exclusive jurisdiction of the English courts.
