The Environmental Liability Directive (ELD) could have a significant effect on your business

The Environmental Liability Directive (ELD) is aimed at preventing significant environmental damange by forcing businesses that pollute to pay for the cost of prevention and remediation.

When it comes into effect, the new Directive will have far reaching effects and could have an impact on every business that disharges pollution. The Environment Agency will have enhanced powers to require businesses to:
  • 'put right' environmental damage that has occurred
  • provide 'complementary remediation' to similar resources if original damage cannot be put right
  • compensate for the time that a resource has suffered damage
