The Carriage of Dangerous Goods and Use of Transportable Pressure Equipment Regulations 2004 (SI 2004/568)
These regulations incorporate provisions of the following EU Directives:
- 94/55/EC - the ‘ADR’ framework Directive that set out the requirements for carriage of dangerous goods by road
- 96/49/EC - the ‘RID’ framework Directive that sets out the requirements for carriage of dangerous goods by rail
The regulations have revoked many earlier regulations and amended the following:
- Carriage of Dangerous Goods by Rail Regulations 1996 (SI 1996/2089) as amended by SI 1999/303
- Carriage of Dangerous Goods by Road (Driver Training) Regulations 1996 (SI 1996/2094) ) as amended by SI 1999/303
- Carriage of Dangerous Goods by Road Regulations 1996 (SI 1996/2095) as amended by SI 1999/303
The regulations set out the measures to be taken, including controls on spills and emissions. They also specify exemptions. Responsibility for the preparation of future GB legislation on the transport of dangerous goods by road and rail has transferred from HSE to the Department for Transport (DfT).
Health and Safety at Work etc Act 1974 (Application to Environmentally Hazardous Substances) Regulations 1996 (SI 1996/2075) as amended by SI 1999/40
These regulations enable substances which are dangerous to the environment but do not otherwise endanger the health or safety of workers to be brought within the scope of HSWA74 and to consequently be controlled by the ‘Carriage of Dangerous Goods’ series of regulations.
