Smoking laws

The Smoke-free (Premises and Enforcement) Regulations 2006 came into force on the 1st July 2007.

The regulations clarify what is meant by enclosed and substantially enclosed space and give details on enforcement agencies. The enabling legislation is the Health Act 2006.

Essentially the new requirements mean that smoking is not be permitted in any 'enclosed space'. This includes rooms and portable units previously set aside for smoking.

Government has also published a total of five sets of smoke free regulations: Premises and Enforcement; Exemptions and Vehciles; PenaltiesVehicle Operators and Signs.

NICE (the National Institute for Health and Clinical Excellence) is an independent organisation responsible for providing national guidance on promoting good health and preventing and treating ill health, supported by the NHS. NICE have published Workplace Smoking Guidance.
