Approved poster and leaflet (r3)
AP or AL means respectively a poster or leaflet in a form approved and published by HSE and periodically revised. Revisions take effect nine months after approval.
Provision (r4,5)
Employers shall ensure AP (latest revision) are kept displayed in readable condition in places reasonably accessible to and in such a position as to be easily seen and read by employees. The name and address of the enforcing authority and the address of the employment medical advisory service for the area must be written on the AP, and the information must not be more than six months out of date.
Alternatively, employers shall give AL to employees upon commencing employment, giving fresh AL following a revision or bringing the revision to their notice in writing. The AL shall be accompanied by a written notice containing the name
and address of the enforcing authority and the address of the employment medical advisory service for the area, and the information shall not be more than six months out of date. For the purposes of notification, where employees work in more than one location they shall be treated as working at the premises from which they are administered.
Exemption (r6)
HSE may, by certificate, grant exempions.
Defence (r7)
It shall be a defence for the accused to prove that he took all reasonable precautions and exercised all due diligence to avoid committing the offence.
