EEF response on proposals for a draft revised Waste Framework Directive

EEF welcomed the opportunity to comment on the draft Waste Framework Directive. The DEFRA consultation canvassed for views on proposals by the European Commission to revise the Waste Framework Directive (WFD) (2006/12/EC) as well as related EU legislation.

The Waste Framework Directive (WFD) was adopted in 1975 (Directive 75/442/EEC) and substantially amended in 1991 (91/156/EEC). The EU Commission published a proposal for a revised WFD as part of its Thematic Strategy on Waste and Recycling 2005.

In response to the DEFRA consultation on the proposal, EEF argued that the interpretation of the definition of waste has caused many problems in the UK. Many materials that were once by-products are now classified as waste and need to comply with waste regulations and apply for waste management licenses, waste carriers licences and waste exemptions, proving a significant barrier to innovative approaches to-reuse, recycling and efficient disposal. We argued that this is against the UK's intention to reduce waste volumes going to landfill and improve the sustainable use of resources and call for a more appropriate definition of waste.

EEF supported the waste hierarchy in principle but urged a flexible approach which is clearly signalled in the Directive. We also stressed the need for clear definitions of the steps within the hierarchy, in particular recycling and recovery, to ensure consistent approaches.
