The final version of the new TUPE Regulations is now out. The Regulations will come into force on 31 January 2014 and will govern all TUPE transfers taking place on or after that date.
There are no significant differences between the final version of the new TUPE Regulations and the draft published in November 2013. Please see our previous HR Briefing, TUPE Regulations Published, which sets out in some detail the content of the new Regulations and the key changes to TUPE 2006.
The Government has committed to providing better guidance on TUPE, and we are expecting this to be published shortly. The Guidance will be particularly important in relation to the question of how far incoming employers will be able to change terms of employees. We will inform our members, and report on the Guidance, as soon as it becomes available.

EEF is running a series of half day seminars in May 2014 to consider the impact of new TUPE and the key issues emerging and to look in a practical way at how both outgoing and incoming employers can operate within the new regime.
