Claimants must register for early conciliation before bringing a tribunal claim

From this week, anyone wishing to bring a tribunal claim must first register with Acas for early conciliation.

The Advisory, Conciliation and Arbitration Service (‘Acas’) has always had the power to attempt conciliation in certain employment tribunal claims.

This power is now a duty to attempt early conciliation in order to avoid tribunal claims being presented in the first place.

From 6 May, registering with Acas for early conciliation has become compulsory for all claimants seeking to present an employment tribunal claim.

However, there is no compulsion on either party to then participate in the process.
