Are you changing a term of the employment contract?

When you are changing employees’ terms and conditions, it will, for reasons dealt with in this section, be important to establish whether you are in fact changing the employment contract. This will include ascertaining whether the term/condition you propose to change is actually part of the employment contract and, if so, whether or not the change is authorised under that or another term (i.e. a flexibility clause).
