Agency workers

This section deals with the Agency Workers Regulations 2010 (the Regulations) and is designed for hirers, rather than agencies.

The Regulations give agency workers the right to be treated in the same way as the hirer’s direct recruits. From the first day of their assignment, they are entitled to equal access to collective facilities/amenities and information about job vacancies. After 12 weeks on the same assignment, they have a right to the same pay, holiday and hours of work as direct recruits doing the same job.

As a hirer, you should protect yourself against liability under the Regulations by making sure that you provide access to the relevant facilities/amenities and vacancies and that you provide the correct information to agencies about the terms they should be offering your agency workers.
