If an agency worker is employed by the agency on a valid Pay Between Assignments contract (PBA contract), they do not have the normal right to the same pay as your direct recruits under the Agency Worker Regulations (the Regulations). This is sometimes known as the Swedish derogation model, as it is based on an exception to the Agency Workers Directive negotiated by the Swedish Government.
